Travel Down The Line – Terms & Conditions (January 2017)

  • Down The Line Limited (2015) is a New Zealand registered limited liability Company trading as Travel Down The Line.

  • This contract is with Down The Line Limited t/a Travel Down The Line and its’ customers. Down the Line Ltd. may be referred to as ‘our’, ‘us’ or ‘we’ and customers may be referred to as ‘passenger’, ‘you’ or ‘your’ in the terms and conditions that follow. 

 

  • All fares published on our webpage www.traveldowntheline.nz supersede all prices previously advertised.

  • Any sales promotions advertised are valid for the specified time only and will be subject to specific published terms and conditions that apply at the time of sale.

  • All prices are quoted in New Zealand Dollars (NZD) and include New Zealand Goods and Service Tax (GST) of 15%.

 

  • All bookings for the services that Travel Down The Line provide must be made in advance.  

  • We will confirm your booking by reply text message or email. We will assume your agreement to proceed with the sale contract unless we receive written advice to cancel your contractual agreement with us.

  • All bookings are subject to availability at the time of reservation.

  • We reserve the right to cancel any ticket or booking or to refuse to carry any passenger where payment has not been received by us within the specified time.

  • Accepted methods of payment include by credit card online or cash to the booking agent or driver prior to commencement or tour or private hire arrangement, or as agreed between us and you.

  • Bookings can be made online, via text message or via an approved booking agent.

  • Booking agents have the right to charge a booking fee if necessitated at their discretion.

  • All day tours and/or transfers must be paid in full prior to commencement of tour or private hire arrangement.

  • Cancellations of all day tours and/or transfers within 8 hours of tour/transfer may incur a 20% cancellation fee at our discretion.

  • All bespoke multi-day tours and/or multi-day private hire arrangements must be paid for in full 30 days prior to commencement of tour/hire unless otherwise agreed to in writing by Down The Line Ltd.

  • Cancellations of bespoke multi-day tours and/or multi-day private hire will incur the following penalties: 50% of cost within 30 days; 100% of cost within 7 days at our discretion.

     

  • Changes made by operators of attractions and activities we visit are outside of our control but we will endeavour to minimise such occurrences by close liaison with the operators.

  • We accept no responsibility for any incident, delay or changes to the arrangements, which are outside of our control.

  • Your tour itinerary will be followed as closely as possible but in some cases may be affected by adverse weather or road conditions; in such cases alternative destinations and activities of a similar nature will be offered.

  • Down The Line Ltd reserves the right to make changes to our itineraries or cancel any tour or private hire arrangement, at any time prior to departure if something beyond our control deems it necessary; including natural disasters, political instability, terrorism, weather, cultural conditions or other external events. Should we deem it necessary to cancel a planned tour or private hire arrangement, we will contact you directly.

  • If a tour or private tour arrangement is cancelled, we are not responsible for any incidental expenses that you may have incurred as a result of your booking such as visas, vaccinations, or non-refundable flights.

  • We will take all reasonable steps to provide an agreeable tour, we do not accept liability for any loss of enjoyment experienced by passengers due to circumstances beyond our control, nor do we accept liability for any loss beyond its reasonable control and provides no warranties in addition to those set out under the The Fair Trading Act 1986, and nothing herein restricts any passenger from exercising your rights and remedies pursuant to law.

  • We accept no responsibility for and injury to persons or damage or loss of personal possessions belonging to those persons except that which we have legal obligation so to do.

  • Travel insurance is your responsibility. The Ministry of Foreign Affairs and Trade strongly recommends you obtain travel insurance at the time you pay for your travel. Failure to obtain travel insurance is at your own risk. When obtaining travel insurance you must declare all pre-existing medical conditions and any adventurous activities, e.g. skiing, mountain biking, etc.

  • If you are injured whilst in New Zealand, ACC may be able to help with the cost of the treatment and support you need whilst you're here. However, it is important to be aware that you cannot sue for personal injury - ACC replaces that right. Furthermore, ACC only covers treatment and rehabilitation costs whilst in New Zealand; it is not a replacement for travel insurance and does not cover illness, disrupted travel plans or emergency travel to get you back home.

  • Down The Line Ltd hold a current Transport Service License as legislated under the Transport Services Licensing Act 189 which allows us to operate a Private Hire Service. 

  • We are a New Zealand registered Private Hire Service operator and are fully compliant with all requirements that a holder of the licence must fulfil, this includes providing a vehicle and driver which are fully certified as required by law.

 

  • All vehicles are groomed prior to commencement of tour with full care being taken throughout the tour.

  • Where seat belts are fitted, it is the responsibility of the passengers to use them.

  • No smoking will be allowed in the vehicle.

  • Any damage caused to the vehicles by the hirer will be charged for.

These Terms are governed by, and shall be construed in accordance with, the laws of New Zealand.  Both parties submit to the exclusive jurisdiction of the courts of New Zealand.

Down The Line Ltd reserves the right to review these Terms at any time.  If, following any such review, there is to be any change in these Terms, that change will take effect from the date the on which the we as representatives of Travel Down The Line  notify, you the Customer of any such change.
